Form 2290 in Delaware: Schedule 1 & DMV Registration

Delaware’s four DMV locations handle the whole state — and its motor carrier office checks the HVUT deeper than most: fleets using owner-operators must include each owner-operator’s receipted Schedule 1, “or the application will be returned.”

Quick answer: Standard trucks register at Delaware’s four full-service DMV locations (Delaware City, Greater Wilmington, Dover, Georgetown). Apportioned (IRP) registration runs through the Motor Carrier Services Section in Dover — same campus as the Dover DMV, different operation — with renewals online through Motor Carrier Services Online, by email, fax, or mail. Owners of vehicles over 55,000 pounds “must provide a current Federal Heavy Weight Use Tax Form 2290 prior to renewal” — Delaware’s own, slightly nonstandard name for the HVUT.

Where do I register a heavy truck in Delaware?

Intrastate: any of the four DMV locations. Interstate: the Motor Carrier Services Section at the Public Safety Building, 303 Transportation Circle, Dover — which oversees IRP, IFTA, UCR, and Form 2290 compliance under one roof. New accounts and new vehicle registrations are by appointment (302-744-2702); renewals go through Motor Carrier Services Online or by email, fax, or mail. Delaware quirks worth knowing: don’t send payment with IRP applications — a billing notice follows — and IRP vehicles are exempt by statute from Delaware’s periodic safety inspection at renewal, though a new account still needs an initial Delaware DMV inspection (federal DOT inspections don’t count).

What proof of HVUT payment does Delaware accept?

  • The original or a photocopy of the receipted Schedule 1 (Form 2290) — stamped or e-file watermarked — listing your equipment by VIN; or
  • A copy of the Form 2290 with Schedule 1 plus photocopies of both sides of the cancelled check covering the IRS payment.

Two Delaware particulars: the owner-operator sweep — a fleet application must include the receipted Schedule 1 (or cancelled-check combo) for every leased-on owner-operator’s truck, or the whole application is returned — and the per-VIN matching, which makes a Schedule 1 that omits a truck useless for that truck. Delaware’s paperwork even routes 2290 authority through its power-of-attorney forms, so an agent can handle it for you. The state also publishes the IRS Taxpayer Assistance appointment line (844-545-5640, Dover and Wilmington) for anyone needing a walk-in stamp — e-filing returns the watermarked copy in minutes. The 60-day rule for newly acquired vehicles

Proof isn’t required on new or used units being titled and registered within 60 days of the date shown on the bill of sale. The new-carrier checklist implements the same idea in reverse: it demands the stamped Schedule 1 only for vehicles already in the applicant’s name and registered at 55,000 pounds or more. The counter convenience never touches the federal deadline — Form 2290 is due by the last day of the month following first use, and note that Delaware’s own compliance calendar nudges carriers even earlier (it lists June 30, ahead of the actual August 31 IRS deadline for July filers). What to bring

  • Receipted Schedule 1 (or photocopy) for the current period, listing every VIN — including each owner-operator’s, for fleets
  • Or the 2290-with-Schedule-1 copy plus cancelled check, both sides
  • Bill of sale, for units titled and registered within 60 days of its date
  • Manufacturer’s GVWR proof for vehicles registering over 26,000 pounds, title documents, and insurance — and no payment with IRP applications; wait for the bill

Frequently asked questions

Is there a Delaware Form 2290?
No. Form 2290 is a federal IRS return — Delaware just calls it the “Federal Heavy Weight Use Tax” on its registration page. Same tax, same Schedule 1.

I lease on owner-operators — whose 2290s do I need?
Theirs, each of them: Delaware requires copies of the owner-operators’ receipted Schedule 1s (or their 2290-plus-cancelled-check) with the fleet application, or the application is returned.

Where exactly is the IRP office?
Same campus as the Dover DMV — 303 Transportation Circle — but it’s the Motor Carrier Services Section in the Public Safety Building, appointment-driven, not the regular DMV lanes.

Will they accept the electronic watermarked Schedule 1?
Yes — the receipted Schedule 1 covers both the IRS stamp and the e-file watermark, and the cancelled-check fallback remains on the books for paper filers.
